OVERVIEW

Welcome to Sabrina Giacalone (the “Store”). The terms “we,” “us,” and “our” refer to Sabrina Giacalone. We operate this Store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Sabrina Giacalone is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (the “Terms”), describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services (including browsing, purchasing, or downloading digital products), you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, complete, and that you have all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS

We have made every effort to accurately represent our products and services. However, colors, images, and product appearance may vary depending on your device and settings. We do not warrant that the appearance or quality of any products will meet your expectations or be exactly as displayed.

Product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance and process payment.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted, especially for orders containing digital products.

In the event we do not accept, make a change to, or cancel an order, we will attempt to notify you via the email, billing address, and/or phone number provided.

You represent and warrant that your purchases are for your personal or household use and not for commercial resale or export.

SECTION 4 – DIGITAL PRODUCTS; LICENSE; NO RETURNS/REFUNDS

4.1 Digital Products Are Final Sale

All digital products are non-refundable and non-returnable, including but not limited to eBooks, downloadable files, digital add-ons, bonus materials, license keys, companion materials, and any other digital content.

Any bundle or package that includes any digital content is also final sale (even if the bundle includes a physical item). If a physical component arrives damaged or defective, we may replace the physical component where available; however, we do not refund bundles that include digital access.

4.2 Digital License and Use Restrictions

When you purchase a digital product, you receive a limited, personal, non-transferable, non-sublicensable license to access and use the digital product for your own personal, non-commercial use.

You may not copy, reproduce, distribute, publish, publicly display, share, resell, or exploit any digital product (or any portion of it) without our prior written permission. You may not upload digital products to file-sharing services, repositories, websites, social platforms, or send them to others.

We reserve the right to suspend or terminate access to digital products if we reasonably believe there has been unauthorized sharing, fraud, abuse, or a violation of these Terms.

SECTION 5 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be shown in your order confirmation email. Unless expressly stated, prices do not include taxes, shipping, handling, customs, or import charges.

We may offer promotions governed by separate terms. If there is a conflict, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information and to promptly update your information as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay all charges at the posted prices, including shipping/handling and applicable taxes.

SECTION 6 – SHIPPING, DELIVERY, AND RISK OF LOSS

We are not liable for shipping and delivery delays. Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our control.

Once we transfer products to the carrier, title and risk of loss pass to you, to the fullest extent permitted by law.

SECTION 7 – RETURNS FOR PHYSICAL GOODS (SUMMARY; SEE REFUND POLICY)

Returns for physical goods are governed by our Refund Policy [LINK TO REFUND POLICY]. As a summary only (and not a replacement for the Refund Policy):

Physical items must be returned in new, unused, resalable condition and in original packaging (or protective packaging).
Books must be returned unread and unused (no creased/broken spine, writing, stains, odors, bent corners/pages, or other signs of reading/handling that prevent resale as new).
We may deny returns or issue partial refunds if returned items show wear, use, or damage.

SECTION 8 – GIFT CARDS

Gift cards are non-refundable and cannot be exchanged for cash except where required by law.

SECTION 9 – INTELLECTUAL PROPERTY

Our Services—including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof—are owned by Sabrina Giacalone, our affiliates, or licensors and are protected by U.S. and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download (except where permitted for your personal use), store, or transmit any material on the Services without our prior written consent.

You may be provided access to third-party tools we do not monitor or control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties or endorsement. We have no liability arising from your use of optional third-party tools.

The Services may contain links to third-party websites or content. We are not responsible for evaluating the content or accuracy of third-party materials. If you access third-party sites, you do so at your own risk. Any complaints or concerns regarding third-party products or services should be directed to the third party.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Sabrina Giacalone is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Sabrina Giacalone. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sabrina Giacalone, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sabrina Giacalone.

If you submit ideas, suggestions, feedback, reviews, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.

You represent and warrant that you own or have all necessary rights to the Feedback and that it complies with these Terms. We are not obligated to maintain Feedback in confidence, pay compensation, or respond.

SECTION 15 – ERRORS, INACCURACIES, AND OMISSIONS

Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, and availability. We reserve the right to correct errors and to cancel orders if any information is inaccurate at any time without prior notice.

SECTION 16 – PROHIBITED USES

You may use the Services for lawful purposes only. You may not use the Services to violate laws, infringe intellectual property, harass others, transmit malicious code, engage in fraud, attempt unauthorized access, scrape/crawl the site, or interfere with security features.

To the fullest extent provided by law, in no case shall Sabrina Giacalone, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Services or products purchased through the Services, including lost profits, lost revenue, loss of data, or replacement costs, even if advised of the possibility.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify, defend, and hold harmless Sabrina Giacalone, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or violation of a third party’s rights.

SECTION 23 – ASSIGNMENT

You may not delegate, transfer, or assign this Agreement without our prior written consent. We may transfer, assign, or delegate these Terms without notice.

SECTION 24 – GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Rhode Island, United States of America, without regard to conflict of laws principles. You and Sabrina Giacalone consent to venue and personal jurisdiction in the courts located in Rhode Island, United States of America.

SECTION 25 – CHANGES TO TERMS

We reserve the right to update, change, or replace any part of these Terms by posting updates. It is your responsibility to check this page periodically for changes. Your continued use of the Services following changes constitutes acceptance of those changes, to the extent permitted by law.
